Terms of Service
These Terms of Service (“Terms”) govern your use of the Fleet Cadence application and related services (the “Service”) provided by Zipster Delivery Services (“we,” “us”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
The Service is a workforce-operations tool for Amazon Delivery Service Partners (DSPs) and their staff. Accounts are issued by a DSP to its employees or contractors. You must be at least 18 and authorized by your employer to use the Service, and you agree to use it only for legitimate work purposes.
2. Accounts & security
Keep your login credentials confidential and do not share your account. You are responsible for activity under your account. Notify your employer’s administrator promptly if you suspect unauthorized use. Your employer may create, suspend, or remove your access at its discretion.
3. Acceptable use
You agree not to:
- Access data you are not authorized to view, or attempt to circumvent access controls or tenant separation;
- Upload unlawful, harassing, or infringing content, or use messaging to harass others;
- Interfere with, disrupt, probe, or overload the Service or its infrastructure;
- Reverse engineer, scrape, or copy the Service except as permitted by law;
- Use the Service to violate any law or any third-party service’s terms (including Amazon or ADP).
4. Your employer’s role & data
The Service is provided to your employer, who controls the data entered and how it is used. Handling of personal information is described in our Privacy Policy. Your use is also subject to your employer’s own policies.
5. Third-party services
The Service can connect to third-party systems your employer configures (for example ADP Workforce Now and Amazon Logistics). Those services are governed by their own terms and privacy policies, and we are not responsible for them. Availability of an integration may change if a third party changes or discontinues its service.
6. Intellectual property
The Service, including its software, design, and content we provide, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for its intended workplace purpose. Data your employer enters remains your employer’s.
7. Availability & changes
We may modify, suspend, or discontinue features at any time. We aim for reliable operation but the Service is provided on an “as available” basis and may have downtime for maintenance or factors beyond our control.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be accurate or available.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
10. Termination
Your access ends when your employment or authorization ends, or if these Terms are violated. Provisions that by their nature should survive termination (e.g. intellectual property, disclaimers, limitation of liability) will survive.
11. Governing law
These Terms are governed by the laws of Michigan, without regard to conflict-of-laws rules.
12. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the revised Terms.
